1. Acceptance of Terms

By downloading, accessing, or using the Rx Armor mobile application or website ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. You must be at least [Age Requirement] years old and capable of forming a binding contract to use Rx Armor. We reserve the right to refuse or terminate service to anyone at any time. We may update these Terms periodically and will notify users of significant material changes.

2. Description of Service

Rx Armor provides a digital platform to help consumers and patients understand medication coverage estimations based on user-inputted scenarios such as insurance, disease state, and prior medications. The intent is to provide clarity and reduce confusion at the pharmacy counter.

The Service strongly acts as a consumer wellness tool. All output constitutes informational recommendations and estimates. Rx Armor does not provide guarantees of coverage, drug safety assurances, or pharmacy savings.

3. Wellness Tool / Not Medical Advice

Rx Armor is NOT a medical device, diagnostic tool, or licensed healthcare provider.

• We do not provide medical advice, diagnosis, or treatment regimens.
• The App is not a substitute for professional clinical judgment by healthcare professionals.
• We do not replace your doctor, pharmacist, or insurance broker.
• Rx Armor is not liable for medical outcomes, injury, or health complications arising from treatments or medications discussed within the App.

Users must always consult their licensed health providers for medical decisions.

4. User Responsibilities

As a user, you agree to:

• Provide accurate and truthful information regarding your insurance and medication history to ensure the best utility of the App.
• Keep your account credentials secure.
• Use the Service lawfully and appropriately.
• Ultimately verify all coverage explicitly with your insurance company or pharmacist before purchasing medications.
• Review external terms and conditions directly with drug manufacturers if utilizing manufacturer copay cards.

5. Account Creation and Security

You may be required to register an account. You agree to provide accurate registration information. You are solely responsible for managing your password security and must not share your account with anyone else. You agree to immediately notify us of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these security protocols.

6. User Conduct / Prohibited Uses

You agree not to engage in any of the following prohibited activities:

• Using the App for fraudulent or unlawful purposes.
• Attempting to bypass, reverse engineer, or circumvent App security measures.
• Scraping, data mining, or extracting underlying App data mechanically.
• Impersonating any other person or entity, including health professionals or insurance representatives.
• Distributing spam, viruses, or malicious software through the App.

7. Intellectual Property

All content, trademarks, logos, structure, and database rights within the App are the exclusive property of Rx Armor LLC. We grant you a limited, non-exclusive, non-transferable license to stream/download and use the App for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from our intellectual property without express written consent.

8. Third-Party Links and Services

The Service may provide links or portals to third-party copay assistance programs, manufacturer savings cards, or external health websites. These third-party sites are not owned or controlled by Rx Armor. The inclusion of these links does not constitute our endorsement of the third-party's content, medications, or business practices. We are not responsible for their availability, privacy behaviors, or terms.

9. No Warranties / Disclaimers

The Service is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis.

• We make no guarantees regarding the accuracy, reliability, or completeness of our formulary database.
• We cannot and do not guarantee insurance coverage approval for any specific drug.
• We cannot guarantee the continued availability of copay savings or manufacturer programs.
• Formulary rules, insurance policies, and drug prices change dynamically; our information may occasionally be outdated.
• We do not warrant that the App will be free from errors, bugs, or downtime interruptions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RX ARMOR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
(B) ANY DECISIONS MADE REGARDING MEDICAL TREATMENT OR INSURANCE COVERAGE;
(C) DENIALS OF COVERAGE BY YOUR INSURANCE; OR
(D) MANUFACTURER COPAY CARD REJECTIONS OR ALTERED TERMS.

11. Indemnification

You agree to defend, indemnify, and hold harmless Rx Armor LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party right.

12. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using Rx Armor, you consent to our data collection practices detailed therein. Specifically, you acknowledge our position as a consumer wellness tool exempt from HIPAA rules, confirming that we do not process Protected Health Information (PHI) under the direction of covered entities.

13. Medication Coverage Information

Important Clarifications: Any medication recommendations provided by the App are estimates modeled on generalized formulary behavior. Your specific insurance company holds the sole power to dictate actual coverage. Furthermore, your prescribed medications may be subject to Prior Authorization or Step Therapy requirements, pushing you to try alternate generics first. You explicitly accept that our insight does not supersede the insurance company’s final ruling.

14. Alerts and Notifications

Rx Armor may offer an optional feature to notify you of formulary changes or authorization expirations. These alerts are for your convenience only and are not medical advice. We cannot guarantee that the App will detect every pertinent policy change. You have the right to opt-out of these notifications at any point.

15. Modifications to Service

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We may also dynamically alter our coverage data logic as the healthcare market shifts. We hold no guarantee of continuous availability for any specific feature.

16. Termination

You may stop using our Service and close your account at any time through the App settings. Rx Armor may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease.

17. Dispute Resolution

A. Governing Law

These Terms shall be governed by the laws of the State of [State], United States, excluding its conflict of law provisions.

B. Informal Resolution

Before filing a claim against Rx Armor, you agree to attempt to resolve the dispute informally by contacting legal@rxarmor.com. We will try to resolve the dispute within 30-60 days.

C. Arbitration

If the dispute cannot be resolved informally, any controversy or claim will be settled by binding arbitration, administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. You waive the right to trial by jury or to participate in a class action lawsuit. Claims resolving to small claims court may be exempt from this mandatory arbitration.

18. Miscellaneous

These Terms constitute the entire agreement between you and Rx Armor LLC. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision will not be considered a waiver. You may not assign or transfer your rights under these Terms, but Rx Armor may assign its rights without restriction.

19. Apple App Store Specific Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Rx Armor only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support services. In the event of any failure of the App to conform to applicable warranties, you may notify Apple, but to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple is a third-party beneficiary of these Terms and will have the right to enforce them against you.
